Phoenix safety technology company signs $1.2M settlement agreement

The Maricopa County Air Quality Department announces $1,485,074.75 in air quality violation settlements made during the month of July 2007. A list of all settlement cases for the month is posted to the bottom of this document including the following three highest settlement cases for the month:

Simula, Inc signed a $1,200,000 settlement agreement on July 31st for eight alleged air quality violations. Those violations include failure to report emissions inventory for two company facilities, failure to obtain an air quality permit for two company facilities and failure to properly cover volatile organic compound [VOC] containing material. The location of the violations occurred at the following two locations:

  • 7822 South 46th Street, Phoenix, AZ 85004
  • 10016 South 51st Street, Phoenix, AZ 85044.

Simula, Inc. is located at 7822 South 46th Street in Phoenix. Payment is due in full by September 7, 2007.

Lennar Communities Development, Inc. and its subsidiaries U.S. Home Corporation, and Greystone Homes, Inc., signed a settlement agreement for $37,277 on July 17th. The agreement resolves nine alleged air quality violations including failure to obtain a dust control permit, failure to control and clean up trackout and failure to control dust during operations. The violations occurred at the following locations:

  • 9421 East Rimrock Scottsdale, AZ
  • Germann Road & McQueen Road Chandler, AZ
  • 51st Avenue & Baseline Road Phoenix, AZ
  • 43rd Avenue & Dobbins Road Phoenix, AZ
  • Cibola Vista-Parcels 1, 2 & 5 - Lake Pleasant Road & Jomax Road

Lennar offices are located at 1150 West Grove Parkway, #110, Tempe, Arizona 85283. The company paid its settlement amount in full on July 27th.

Southwest Gas Corp. signed a settlement agreement for $43,710 to resolve nine alleged air quality violations. Those violations include failure to control dust during operations, failure to post dust permit and dust control plan on the worksite, failure to record dust control measures in required daily written log and failure to use water for dust control.

The violations occurred at the following locations:

  • 91st Avenue & Lower Buckeye, Phoenix AZ
  • East side of Jackrabbit Trail: Van Buren to Yuma, Buckeye, AZ
  • 21st Avenue & Whispering Wind Drive, Phoenix, AZ
  • Sarival & MC85 (SWC), Buckeye, AZ

Southwest Gas Corp. offices are located at 9 South 43rd Avenue, Phoenix, Arizona 85009. The company paid its settlement fines in full on July 19th.

Settlement cases noted above reflect the three highest settlement amounts in July. A complete list of enforcement cases settled in the month of July 2007 is listed on the Maricopa County Air Quality Department website.

The Maricopa County Air Quality Department’s enforcement division is responsible for settling air pollution notices of violation which occur within Maricopa County. Enforcement action taken on local companies violating clean air rules and regulations will be published by the department on a monthly basis.

Track-out is defined as dust or material that may adhere to and form into a mass on the surfaces of motor vehicles, haul trucks and/or equipment (including tires) and such material has fallen or been deposited onto a paved area accessible to the public.
