Air Quality Violators Pay Over $325K in February

First Supplemental Environmental Package Included in Settlement Agreement

The Maricopa County Air Quality Department announces $325,525 in air quality violation settlements were made during the month of February 2007.  Engle Homes created a Supplemental Environmental Package [SEP] to be included in its settlement agreement and developed an educational dust control DVD. This is the first SEP the Air Quality Department has assisted in producing and is available free to the public on a first come, first serve basis. Details of February’s settlement agreements are listed below including:

 

Engle Homes signed a $59,660 settlement agreement on February 2, 2007 for nine alleged dust and permit requirement violations. Those violations can be found in the table listed below. Engle Homes’ office is located 2600 N. Central Avenue, Suite 1400 in Phoenix.

 

The SEP developed by Engle Homes is a video that was professionally narrated in English and Spanish, each version being approximately ten minutes in length. The video focuses on the most common violations committed on construction sites and describes how to control dust and avoid these violations.  Director Bob Kard with the Maricopa County Air Quality Department states, “Our enforcement goes beyond a financial penalty. We encourage future compliance through educational and informational projects such as this one.” The cost of the video was $11,505.  The total settlement package with penalty and cost of the SEP was $71,165. Payment was received in full on February 14, 2007.

 

DR Horton signed a $62,500 settlement agreement on February 13, 2007 for 15 alleged dust violations. Details on those violations can be found in the table listed below. DR Horton’s office is located at 8125 N. 23rd Avenue, Suite 100 in Phoenix. Payment was received in full on February 16, 2007.

 

Beazer Homes Holding Corp. signed a settlement agreement for $31,297 on February 21, 2007 for eight alleged dust and permit requirement violations.  Details on those violations can be found in the table below. Beazer Homes Holding Corp. office is located at 2005 W. 14th Street, Suite 100 in Tempe. Payment was received in full on February 28, 2007.   Settlement cases noted above reflect the three highest settlement amounts in February.  A complete list of enforcement cases settled in the month of February is attached and available on the Maricopa County Air Quality Department website: www.maricopa.gov/aq.
